Industrial Design Registration in Armenia: A Practical Guide for Applicants

Industrial design is a key object of intellectual property that allows businesses to protect the appearance of their products and maintain a competitive advantage in the market. In Armenia, the registration procedure is relatively fast and straightforward, but it has specific features that applicants should take into account.

This article explains the requirements for industrial design protection, the registration procedure, and key practical aspects that may affect the outcome.

What Is an Industrial Design

Industrial design is the appearance of a product or its part, resulting from its characteristic features, in particular lines, colors, shapes, structure, as well as materials and/or its ornamentation.

Protection applies exclusively to the visual appearance of the product, not to its technical function.

Criteria for Protection in Armenia

Under Armenian law, an industrial design must meet two criteria:

Novelty

A design is considered new if it has not been disclosed anywhere in the world before the priority date.

Originality

An industrial design is considered original if the overall impression it produces on an informed user differs from the overall impression produced by any other industrial design.

“Grace Period”: An Important Advantage

In Armenia, a so-called “grace period” of 12 months is available.

This means that if a design has been disclosed by the author (for example, at an exhibition or on the internet), the applicant has 12 months to file an application without losing novelty.

This is particularly important for:

• startups;

• designers;

• companies that have already started promoting their product.

Patent Procedure: How It Works in Practice

The industrial design patenting procedure in Armenia is characterized by a clear structure and relatively short timeframes.

1. Filing the Application

The application includes:

• a request for registration;

• representations of the design;

• details of the applicant and the author;

• a description (if necessary);

• a power of attorney (if required);

• a document confirming payment of the prescribed official fees.

2. Formal Examination (about 10 days)

At this stage, the following is verified:

• the presence of all required documents;

• correctness of оформления;

• payment of fees.

Based on the results of the preliminary examination, a decision is made to publish the application and to initiate the substantive examination.

3. Publication of the Application

Information about the application is published in the next issue of the official bulletin of the IP Office of the Ministry of Economy of the Republic of Armenia (hereinafter – the Armenian IP Office).

From the date of publication, the next stage begins.

4. Substantive Examination (3 months)

The substantive examination lasts 3 months and includes:

• a 2-month publication period, during which third parties may file objections against the registration of the design;

• consideration of any such objections, taking into account the applicant’s arguments.

5. Decision

Based on the results of the examination, a decision is made:

• to grant a patent, or

• to refuse the grant of a patent.

The decision is made taking into account:

• any objections filed by third parties;

• the applicant’s response to such objections.

6. Grant and Publication

If the decision is positive, the applicant must:

• pay the patent grant fee;

• pay the fee for the first 5 years of protection.

After that, information on the granted design is published in the next issue of the official bulletin of the Armenian IP Office.

Term of Protection

An industrial design in Armenia is protected:

• for 5 years from the filing date;

• with the possibility of renewal up to 25 years.

International Industrial Design Protection

If your business is not limited to the Armenian market, it is important to consider an international protection strategy in advance.

There are two key mechanisms:

The Hague System for International Registration

The World Intellectual Property Organization administers the Hague System, which allows applicants to:

• file a single international application;

• designate multiple countries;

• manage their rights in a centralized manner.

This is an optimal solution for companies operating in global markets or planning to export.

The Eurasian System for Industrial Designs

Through the Eurasian Patent Office, protection can be obtained in eight countries of the region through a single procedure.

Advantages include:

• a single application;

• a unified examination;

• a single protection document.

This is particularly convenient for businesses targeting markets in the Eurasian region.

Practical Recommendations

Taking Armenian practice into account, applicants are advised to:

• file the application as early as possible (despite the “grace period”);

• conduct a prior search;

• pay careful attention to the quality of design representations;

• be prepared for possible third-party objections;

• plan an international protection strategy in advance.

Common Mistakes

In practice, the following issues are frequently encountered:

• disclosure of the design before filing without proper risk assessment;

• poor-quality visual representations;

• underestimating the opposition stage;

• lack of a protection strategy beyond a single country.
