Cost of Trademark Registration in Armenia

Trademark registration in the Republic of Armenia requires payment of official fees established by law and may also include expenses related to the preparation and prosecution of the application. The total cost of registration depends on several factors, including the number of classes of goods and services, possible fee reductions, and whether professional assistance is required.

This article explains what the cost of trademark registration in Armenia consists of, which official fees must be paid, and in which cases fee reductions may apply.

Where trademark registration is carried out

Trademark registration in the Republic of Armenia is carried out by the

Intellectual Property Office of the Republic of Armenia.

This authority receives applications, conducts examination, and issues decisions on registration. Official fees are paid in accordance with the rates established by the legislation of the Republic of Armenia.

What the cost of registration consists of

The cost of trademark registration usually includes:

  • official filing fee
  • examination fee
  • additional fees for extra classes
  • registration fee
  • renewal fee
  • professional service fees (if a representative is involved)

The total amount depends on the specific application.

Official filing fee

An official fee must be paid when filing a trademark application.

The filing fee is: 30,000 AMD

Proof of payment is a mandatory document of the application.

The filing date is accorded only if all required documents are submitted, including the document confirming payment of the official fee.

If the fee has not been paid, the filing date will not be accorded until proof of payment is provided.

Examination fee

After filing, the application is subject to examination, for which the following official fee is charged: 40,000 AMD

If the application covers more than one class of goods or services, an additional fee must be paid: 15,000 AMD for each class above one

Classes are determined according to the Nice Classification of Goods and Services.

Priority claim fee

If priority from an earlier application is claimed, an additional fee must be paid:

10,000 AMD for each priority application

This applies, for example, when claiming convention priority.

Registration fee

After completion of substantive examination and issuance of a decision to register the trademark, a registration fee must be paid.

The registration fee is: 50,000 AMD

Only after payment of this fee is the trademark entered into the State Register and the certificate issued.

Renewal fee

Trademark registration is valid for 10 years from the filing date.

To maintain protection, the registration must be renewed.

The renewal fee for each subsequent 10-year period is:

120,000 AMD

plus

10,000 AMD for each class above one

Renewal must be requested within the time limits established by law.

Fee reductions

The legislation of the Republic of Armenia provides for reductions of official fees in certain cases.

Fee reductions are established as follows:

  • for natural persons — 75% reduction
  • for legal entities with up to 25 employees — 75% reduction
  • for legal entities with 25 to 100 employees — 50% reduction

To obtain a fee reduction, the applicant must provide documents confirming the number of employees at the date of payment of the official fee.

In practice, fee reductions are normally applied to natural persons and to Armenian legal entities whose number of employees can be confirmed by the tax authorities.

For foreign legal entities, the application of fee reductions may be limited, since the competent authorities may not be able to verify the relevant information regarding the number of employees.

Therefore, in many cases foreign companies pay the official fees in full.

Number of classes and its effect on the cost

When filing an application, the goods and services must be specified according to the Nice Classification.

The cost of registration depends on the number of classes.

The more classes included, the higher the official fees.

Correct selection of classes is important because:

  • too few classes may result in insufficient protection
  • too many classes increase the cost

It is therefore recommended to determine the appropriate list of goods and services before filing the application.

Costs of preparing the application

The law allows the applicant to file the application independently, however in practice many applicants use professional assistance.

Professional services may include:

  • consultation
  • trademark search
  • selection of classes
  • drafting the list of goods and services
  • preparation of the application
  • filing the application
  • correspondence with the Office
  • replies to examination reports

A properly prepared application reduces the risk of refusal and additional expenses.

Possible additional expenses

During prosecution additional costs may arise, for example:

  • reply to an Office action
  • amendment of the application
  • submission of arguments or observations
  • correction of the list of goods and services

Such expenses can often be avoided if the application is properly prepared from the beginning.

Cost of international registration

After filing an application in Armenia, international protection may be obtained through the

Madrid System for the International Registration of Marks.

The cost of international registration depends on:

  • number of designated countries
  • number of classes
  • international fees
  • professional services

The calculation is made individually in each case.
